Islamic Estate Planning
At Amana Legal PC, we believe that preparing for the future is not only about wealth, it is about responsibility, legacy, and faith. For Muslims in the United States, estate planning goes beyond dividing property. It is a form of worship, ensuring that your wealth is managed and distributed in accordance with the guidance of Allah (SWT) and the principles of the Qur’an and Sunnah.
The U.S. legal system does not automatically honor Islamic inheritance rules. Without proper planning, estates are distributed according to state law, which may conflict with Islamic principles. Islamic estate planning ensures that your wishes are both legally enforceable and faithfully compliant, protecting your family while fulfilling your religious obligations.
Why Islamic Estate Planning Matters
A Divine Obligation: Islamic inheritance is directly mandated by Allah (SWT).
“And spend from that which He has made you successors over.” (Qur’an 57:7)
That framing matters. Because “successors” means this was never meant to stay with you. It passed to you, and it will pass from you.
What you have is an amana. You are holding it for a period of time, managing it, and then handing it forward. And how you pass it on is not left to preference. It’s already been directed by Allah.
The Prophet ﷺ said:
It is not right for a Muslim who has something to bequeath to stay for two nights without having his will written.
